Abstract

The aim is to relate the legal and legislative debates made to promulgate the Mortgage Law number 1237 of 1864 with the construction of the National State in Second Reign and with the institutionalization of liberal legal order. It will be considered the discussions related with the creation of the record of disposals of property and mortgages.
