The objective of this research is to present a historical and sociological reflection on This article aims to analyze critically and comparatively the public policy of drugs that are adopted both in Brazil and in Portugal. With the adoption of the method of bibliographic review, we have hypothesized that respect for democratic values will only be possible in Brazilian territory when the current public policy in criminal matters undergoes profound changes, based on the Portuguese model. Finally, we conclude that, although it is not perfect, the model adopted in Portugal is the one closest to a substantial Democratic State of Law.
