Abstract

The authos defends the autonomy of medical-forensic activities, showing as far as possible not only historical notes of the implantation of the forensic medicine and Forensic Institute in Brazil that linked to the state police service has provoked several conflicting situations about the duties of the expert of saying the truth, but also the pressures exerted by the police departments. The author believes it has been highly promising the initiatives to promote the independence of MFI (Medicine Forenses Institutes) from the 1980's on. Recently it has been better supported by the Presidencial Decret number 1904 (05/13/1996), establishing the National Program of the Human Rights (NPHR), in which the forensic autonomy is concerned. Finally, he makes reference to acts of legislation and ethical principles, and examinates the situation of the main Forensic Institutes in Brazil concerning their degree of autonomy.
