O artigo trata do tema da responsabilidade penal e moral, tal como estudado por P. Fauconnet, discípulo de E. Durkheim. A reflexão de Fauconnet permite acrescentar um elo importante nas reflexões de Durkheim sobre a punição, ao analisar os processos sociais simbólicos que designam a quem a pena será aplicada. São exploradas as articulações entre a justiça penal e os ideais morais constitutivos da sociedade moderna segundo a visão durkheimiana.
