The hidden matrix of modern law: a critic to the contemporary constitutionalism
Keywords:
Constitucionalism - Contract – State of Exception – Bare Life – Law – Power.Abstract
In this paper I try to exhibit Law’s hidden matrix: the state of exception in
which we live – and the correspondent bare life – discussing relations between Law
and power. To prove it, I aim to show how the liberal tradition – matrix of the recent
constitutional theory – hides this phenomenon, being incapable to explain how exactly those who feels more deeply the violence of State – poor people, immigrants, etc. – are evidently out of the supposed contract.
