Abstract

Taking as a starting point the recent Plurinational Constitution of Bolivia (2009), the paper analyzes the historical process that resulted in the indigenous protagonism during the Constituent Assembly, in addition to explore the innovative constitutional principles and articles that emerge from this dialogue. It was verified that the participation of the indigenous people as fundamental political subjects during the processo of writing, as well as the innovative content – because of its decolonizer character – of the new text, shows an unprecedent intercultural exercise in law and politics in Latin America.
