Evolutionary and Comparative Analysis of Legal Norms on Pediatric Oncology in Force in the Argentine Republic

Abstract

This paper aimed to present the oncopediatric regulations in force in the Argentine Republic at both national and provincial levels, through a chronological approach regarding their Evolution and a comparative analysis of the common criteria they present. The enactment of National Law 27.674 is a milestone of significant importance in this field. In turn, there are regulations on oncopediatrics in fourteen provinces (Buenos Aires, Chaco, Chubut, Córdoba, Corrientes, Entre Ríos, La Pampa, Mendoza, Misiones, Río Negro, Salta, San Juan, Tierra del Fuego and Tucumán), while there are nine provinces (Catamarca, Formosa, Jujuy, La Rioja, Neuquén, Neuquén and Tucumán), and nine provinces (Catamarca, Formosa, Jujuy, La Rioja, Neuquén, Neuquén, Neuquén and Tucumán), Jujuy, La Rioja, Neuquén, San Luis, Santa Cruz, Santa Fe and Santiago del Estero, plus the Autonomous City of Buenos Aires), which have not addressed the issue at the regulatory level, do not have explicit regulations on pediatric PC or oncopediatric standards. Even so, the norms of eleven provinces (Río Negro, Entre Ríos, Tucumán, Salta, Chaco, Misiones, Río Negro, Mendoza, San Juan, Corrientes and Chubut) are the antecedents of the sanction of the National Law, which has been adhered to by ten provinces (Chaco, Tierra del Fuego, Misiones, Tucumán, Chubut, Salta, La Pampa, Buenos Aires, Corrientes and Córdoba).
