Brazilian Legislation for Toothpaste and Mouthwash: What Has Changed in 35 Years?

This research aimed to examine the history of Brazilian legislation on dentifrices and mouthwashes, evaluate ease of access, assess the viability of understanding the texts, and identify possible gaps in the standards that regulate the topic. This is a documentary, descriptive-exploratory, and retrospective study, conducted through consultations of Brazilian laws, ordinances, decrees, and resolutions available to the public in the databases of the Ministry of Health, the Health Department of the State of São Paulo, and the Brazilian National Health Surveillance Agency. Four ordinances and 26 resolutions were found. The first fluoridated dentifrice was sold in Brazil in 1988; therefore, regulatory standards for the use of fluoride compounds in dentifrices and mouthwashes were established only in 1989. There have been several updates, revocations, and provisions. Currently, Resolution of the Collegiate Board of Directors No. 752/2022 of the Brazilian Agency is in force. This resolution recommends that the restrictive list for the use of fluorides contained in Resolution No. 530/2021 be complied with, and that products be labeled in accordance with the standards set forth in Resolution No. 646/2022. It was concluded that the history of Brazilian legislation on dentifrices and mouthwashes falls within the period from 1989 to 2024. The ordinances and resolutions governing the topic are easily accessible, with ongoing advances in labeling standards. However, it was noted that understanding the texts is more difficult, as documents are currently made available alongside all other personal hygiene products, cosmetics, and perfumes. Furthermore, this study identified loopholes in current legislation regarding fluoridated toothpastes: there are no requirements for a minimum fluoride concentration, nor are there any requirements that these compounds be made available in their ionic form, which is soluble in enamel. Such gaps can make it difficult to control and prevent tooth decay.
