A análise antitruste de Mercados de Internet

A Nova Economia tem características
muito particulares e que não necessaria-
mente se identificam com a dinâmica de
setores mais tradicionais. Essas especifi-
cidades e a relativa falta de experiência
das autoridades antitruste com esses novos
mercados exigem um cuidado particular
para que sejam minimizados os riscos de
erro nas decisões – falsos positivos podem
ter efeitos extremamente negativos sobre
os incentivos a inovar, prejudicando ele-
mento central desses mercados. O peso
da inovação é especialmente relevante na
compreensão da dinâmica de mercados de
Internet (ou mercados digitais), e a análise
concorrencial deve ser capaz de assimilar a
relevância e o impacto da inovação para os
comportamentos nesses mercados. Desse
modo, a aplicação do direito da concorrência
para analisar condutas ou fusões envolvendo
mercados de Internet não pode confiar, sem
reflexão crítica, em dogmas e postulados que
permeiam a análise concorrencial construída
essencialmente com base em experiências
em setores tradicionais. Se o antitruste
pretende levar inovação a sério, várias
singularidades de mercados baseados na
Internet demandam atenção das autoridades
antitruste, que devem agir com cautela para que os incentivos a inovar não sejam miti-
gados e os mercados continuem dinâmicos.
