Abstract

Based on the analysis of the jurisprudence on sexual crimes instituted by Francisco Viveiros de Castro at the end of the 19th century, this arlicle studies the criteria that the judiciary began using to define those worthy of their"protection" as well as those to be exeluded from it. Herewith, the law exercises a distinct role in the process - defined semantically by the word"civilization" - of political and economic submission of the citizens who belonged to the poor and hard-working segments of society during a period when a class system within capilalist struetures is established in Brazil.
