Abstract

Utilitarianism, with special reference to Classical Utilitarianism, has been considered a Theory of Law that suffers from the defects of an empiricist and positivist interpretation. As such, it would not have an answer to some questions that ask about abstract issues concerning the foundations of the legal order. The aim of this text is to argue that this claim is unfounded.
