The Public Order and the Brazilian Rogatory Letters Execution

Abstract

Public policy rules are a key issue for dealing with exequatur to foreign service of summons in Brazil. An example quite often turning up are numerous cases of attempted enforcement of gambling debts coming from the United States of America, which bring about the issue of public policy. In this paper, such cases are considered as a parameter and an illustration to render the analysis more lively. The choice of the gambling debts is not made by chance, but result from the clear definition of the extention to which the concept of pulic policy is to be applied, considering the definition in itself and the cases to which it can be applied are constantly under discussion and this is not yet fully settled.
