It is a comparative evolution of the common-law and civil-law systems, analyzing the construction of a State of Rights in nations submitted to both systems. It also considers social, economical, ideological and political influences and their impact on the formation and functioning of the Judiciary Power related to the present juridical-legal system. The incapacity of Brazilian's judicial system in assuming a social function is evident. The "juridical safety and sureness" is detrimental to the seeking of justice as an ethical ideal, prejudiced because of archaic and exaggerated formalisms.Downloads
