Abstract

This study aims to determine the precedents set by the Brazilian state courts regarding healthcare issues, through gathering information from the courts’ institutional websites. There were 57 precedents on this matter, distributed among the courts of Bahia (1), Piauí (1), Rio Grande do Sul (1), Ceará (2), Goiás (3), Rio Grande do Norte (3), Pará (4), Pernambuco (12), Rio de Janeiro (15), and São Paulo (15). They covered 24 different health-related topics. The precedents set by the state courts about the same topics were almost identical, except for three. The latter related to the norms for the economic adjustments of health insurance fees. Each followed a different legislation: the Statute of the Elderly, the Consumer Defense Code, and Federal Law No. 9.656 of 1998.
