The objective of this paper is to de-naturalize the premises underlying the social and legal regulations on sexuality according to age, giving emphasis to the social and performative dimension of this category as well as to its differentiated intersection when it comes to gender and social class. For this, legal devices that define sexual minority or the age of consent, as well as the manipulation of such devices in a judicial decision taken by the Brazilian Federal Supreme Court (STF) that explicits controversies on the subject will be analyzed. Finally, I consider questions that may help to examine the preconceptions subjacent to social and legal regulation of sexuality in relation to age: what does sex have to do with consent? How can the capacity of sexual consent be defined? Who is considered capable of consent?Downloads
