Challenges of regulating “digital life”: protection and disruption

The digitalization of social and economic relations has challenged traditional models of legal regulation, particularly in contexts shaped by artificial intelligence, digital platforms, and data-driven markets. These technologies generate new forms of informational asymmetry, concentration of power, and systemic risks to fundamental rights, demanding regulatory approaches that go beyond sector-specific or purely reactive frameworks. This paper addresses examines how the regulation of “digital life” can be structured under conditions of continuous technological disruption. It advances the hypothesis that effective digital regulation tends to assume a hybrid, responsive, and multi-level character, combining state regulation, supervised self-regulation, and regulation by technological design. The study aims to (i) analyze the current legal foundations of digital regulation, (ii) explore tensions between innovation, market dynamics, and fundamental rights, and (iii) propose an integrated reading of adaptive regulatory strategies. Methodologically, the research adopts a qualitative approach, combining doctrinal legal analysis, critical literature review, and examination of selected national and international cases. A deductive-analytical method is employed to assess how regulatory instruments respond to market failures, technological risks, and power asymmetries in digital environments. The article’s main contribution lies in conceptualizing digital regulation as a dynamic process of co-production between legal norms, technological architectures, and market practices.
