Artificial intelligence, national security and due process of law: the Anthropic v. Department of Defense case and its implications for Brazilian Administrative Law

The incorporation of artificial intelligence systems into state activities related to national security has raised concerns regarding the compatibility between automated or AI-assisted decision-making and the fundamental guarantees of due process of law. This article examines this issue through the analysis of the case Anthropic v. Department of Defense. Adopting an analytical and comparative approach, the study explores how the U.S. experience may provide interpretative parameters for the development of institutional safeguards within the Brazilian legal system. In this context, the article examines the constitutional foundations of due process, as well as relevant regulatory instruments such as the Brazilian General Data Protection Law, the Digital Government Law, and ongoing regulatory debates on artificial intelligence. It concludes that the use of algorithmic systems in high-impact administrative decisions requires strengthened mechanisms of transparency, auditability, and judicial oversight in order to safeguard procedural guarantees and preserve the legitimacy of governmental decision-making in technologically complex environments.
