Abstract

This essay presents the idea of administrative precedent as a form to justify the administrative decisions from the perspective of Federal Law No. 9.784 / 99. Thus, it argues how the federal law enables the application of precedents, revealing the internal structure and the context of the transformation of the Brazilian administration occurred in the 1990's. Afterwards, the paper discusses how the theme of administrative proceeding contributed to the application of precedents and also discusses the relation with the New Brazilian Code of Civil Procedure. It will be indicated the elements and the justifications of this new instrument used by public authorities and it will be highlighted the difficulties of operating with precedents in a country without a tradition equal to the common law. Lastly, some final remarks are considered about the changing of Brazilian administrative law.
