The Inconventionality of the suspension of political rights in the administrative improbity

The present study aims to analyze the normative incompatibility of the article 23 of the American Convention on Human Rights (Pact of San José, Costa Rica) with the Administrative Improbity Law (Law No. 8429/1992). The Administrative Improbity Law establishes, among the sanctions, the suspension of the Political Rights for the administrative improbity perfomance. In the other hand. Differently, the Pact of San José provides the possibility of regulating the exercise of these rights due to age, nationality, residence, idiom, instruction, civilian or mental capacity, or sentencing by a competent court in criminal proceedings. Bases on these legal provisions, the aim of this project is to research the incompatibility of the suspension of the Political Rights in administrative improbity actions. Thus, it is important to explore about the hierachy of acts in conflict, analyze the prevalence of normative resolutions on others (specially in cases of international human rights treaties incorporation), in addition to delibarate about the thesis of conventionality control brought by the Brazilian doctrine and its jurisprudence implications.
