‘Sandbox’ regulation as an instrument of securities regulation

Abstract

Technological innovations in the securities market has caused substantive transformations on the financial services provided by traditional players, such as commercial banks, investment banks, bro-ker firms and asset managers. These changes have also caused impact on financial regulators, pushing some of them to adopt new instruments for financial regulation – such as the “sandbox” approach – to give regulatory responses in a more efficient manner in regard to the rapid transformations in the financial market. This concept has not yet been adopted by financial regulators in Brazil. This work unravels the main concepts concerning regulation sandbox, and analyses how international financial regulators have applied it.
