From the Unavoidable Legislative Protection of the Pantanal Mato-Grossense

Access to the balanced environment is ensured by the Federal Constitution. This same law determines in its article 225 that the Mato Grosso’s Pantanal is a biome that needs to be specially protected, with rational use of its natural resources. This biome is among the largest floodplains on the planet, it harbors a rich biodiversity with studies and research in development by institutions around the world, and provides important environmental services of high economic value. Given the relevance of services provided by wetlands to the common good, these areas are protected globally by the Ramsar Convention. In addition to the preservation of fauna and flora, one can not forget the extremely important cultural aspect developed throughout the history of local populations, which have a very peculiar way of living, thinking and expressing themselves and which must also be protected, because it is a legal right with constitutional dignity. However, legal treatment regarding proper use, management and attention to local populations is not clearly and effectively understood. There are still legal difficulties and omissions that must be addressed with a view to achieving the efficient preservation of sensitive and important spaces in the Pantanal ecosystem, aiming to perpetuate the fauna, flora and hydrographic aspects of the region, as well as preservation of the cultural environment of the Pantanal people.
