The New Procurement Law and the National Strategy to Combat Corruption in Brazil: bottlenecks and results

The article addresses the fight against corruption in Brazil, considering the importance of global initiatives, such as the UN Global Compact and the 2030 Agenda, in promoting sustainable development and reducing corruption. The main objective is to analyze the advances and challenges related to anti-corruption legislation and practices in the country, based on the New Procurement Law of 2021. The method used consists of a documentary review, starting from a multiple case study that covered the history of combating corruption in Brazil over 20 years, including Operation Lava Jato, as well as the legislation in force at the time and a content analysis on the New Bidding Law of 2021. The results reveal significant advances in Brazilian legislation, with the objective liability of legal entities for acts of corruption and the search for more transparent and efficient bidding processes. However, gaps and challenges to be faced are identified, such as the effective implementation of laws, impunity, the need for greater transparency and accountability, the promotion of a culture of integrity and ethics, and international cooperation. The study contributes to a critical analysis of the advances and challenges of combating corruption in Brazil, highlighting the importance of improving the implementation of existing laws, strengthening the judicial system, promoting transparency and social control, and developing a culture of integrity and ethics.
