Abstract

The authors studied the principal effects of ethyl alcohol and drugs in the capability of driving motorized vehicles, emphasizing the legal and investigative aspects in the infringements and crimes in the traffic. The usefulness of the clinical exam is discussed in cases of drinkness by alcohol or by any other intoxicating drug, paralel to witness evidence and to chemical exam. Brazilian jurisprudence, in many cases gives more importance to the testemony of a witness than to the results of laboratory exam. Although in most countries the clinical investigation has been simply substituted by the chemical exam, the Brazilian Traffic Code admits it in cases where it is suspected that the driver has exceeded the limits of alcohol permited by law. When the clinical exam is dane, it is possible to have a more precise diagnosis of the influence of alcohol or any other psychoactive drugs upon the individual and even identify diseases that may affect their performance.
