Abstract

This article aims to analyze the discursive clash, concerning the Brazilian Supreme Federal Court’s (STF) understanding of the concept of freedom of expression, based on posts published by Musk on the social network X and on the decision ordering the platform’s immediate suspension issued by Justice Alexandre de Moraes of the STF. The study adopts Critical Discourse Analysis (CDA) (Fairclough, 2001, 2008; Magalhães, 2005) as its theoretical and methodological framework in order to understand how discourses on freedom of expression are mobilized and which strategies are employed to reinforce or challenge power structures. Drawing on a qualitative and interpretivist approach, the article applies Fairclough’s (2008) three-dimensional model: text, discursive practice, and social practice. The data discussion highlights discursive mechanisms underpinning differing conceptions of regulation and censorship in Musk’s discourse, in contrast with Brazilian legislation, in order to contribute to the understanding of freedom of expression in the contemporary digital public sphere.
