Abstract

The limitation on claims for reimbursement to the state ex chequer proposal is put to debate the issue, from the analysis of the legal and administrative arrangements and the public interest and their unavailability as its epicenter, prescription institute while preserving legal certainty in private relationships and their role in public law, in particular, in administrative law, as well as the obligation to return in case of violation of the public purse and controversy of the existence of equitable toll in the proposed action by the State from the wording of Article 37 paragraph 5 of the Federal Constitution of 1988.
