Abstract

This issue of the Journal of Health Law presents the debate on the "Right to health in the Brazilian high courts". The three articles address judicial decisions related to issues of the theory of law and of life in society. The first paper approaches the moral conflicts faced by federal magistrates. The second one the judicialization of the private health insurance. And there is a paper that investigates indemnity decisions of the Brazilian Superior Court of Justice in obstetric damages.
