The right to education occupies a unique place among social rights. Unlike some of its counterparts, its recognition as a fundamental right and its aspiration to universality apparently do not lead to great controversy regarding the legitimacy of its statement; and the legal mechanisms for their enforcement are quite clear. However, despite the universal offer of places in primary schooling, there is still a lot to be done as regards its accomplishment. The hypothesis guiding this article is that its fulfillment requires an elucidation about the legal good itself, the right to education as a public subjective right.
