For a new interpretation of the Constitutional Right of assembly

Popular demonstrations that occurred over the past few years in Brazil have arisen the freedom of assembly into the public eyes, prompting several questions about its scope of protection and possible restrictions. The answers to these questions depend mainly on Constitutional interpretation. However, the few academic studies that performed similar interpretation should be updated, especially considering (i) the new social context, in which interpersonal relationships take place in the cyberspace, and also (ii) the consolidation of a fundamental rights theory that conceives such rights as legal standards structured as principles. Additionally, it is noted that the case law of the Brazilian Supreme Court does not indicate a clear position regarding the characteristics put forward by the Constitution on the exercise of freedom of assembly. In this context, this article seeks to review and to update the study of the constitutional protection afforded to this freedom, in light of the aspects aforementioned, which could not be analyzed in former essays on the subject. The conclusion is that freedom of assembly should contemplate all kinds of meetings (including virtual ones) and that the requirements to exercise this right are directly constitutional restrictions, rather than conditions for its existence.
