Abstract

The main goal of this article is to evaluate the efficacy of the Brazilian contitucional order after the "Brasil Novo" Plan, which established a new monetary order and affected many legal rights and legal guarantees. By pointing out the "antinomie" between the "public" values and the "private" ones in the Constitution of 1988, the article concludes that the Constituional text should be examined rather through its historical "practice" than through its logical formal "structure".
