Abstract

The article begins by analyzing Brazilian legislation prior to the Código Civil (Civil Code). It deals next with the Civil Code and with Family Law in it, with the parts concerning marriage, family and filiation. It analyzes then the evolution of Family Law before 1988, with the Law # 4.737/42 section 1st and its improvement in Law # 4.121/62, known as The Married Woman Act and Law # 6.515/77, the Divorce Law. It ends with a discussion of Family Law in the Constitution of 1988, with a special focus on the loss of relevance of marriage in the frame of the family.
