Abstract

The present work investigates the emergence of the Administrative State in the United States of America, as well as its most evident historical foundations.
Faced with the consequent process of agicification and proliferation of sectoral regulatory norms, some apparent conflicts with the norms and actions of the antitrust authority end up appearing. Systematizing the solutions adopted by the US Supreme Court in these conflicts, detailing the most popular antitrust immunities recognized in that legal system, is shown as a possible instrument to ensure fidelity in the importation of concepts and institutes. More than this, the American experience itself can serve as a model for investigating possible solutions to this process, which also occurs in the Brazilian scenario.
