This article studies the surveillance role of the Brazilian Health Regulatory Agency in cases of hospital infection, and in particular to the Program of Hospital Infection Control in health care, implemented by health institutions to minimize the risks of pathogen infection. It is a theoretic-documental article, with an analysis of the pertinent legislation and the existing risks to patients and health professionals in hospital environments. The study proposes a reflection on the need for the Brazilian agency’s effective inspection actions in healthcare establishments and describes ways of pursuing the implementation of policing powers.
