The regulation of neutral language: a discursive analysis of laws and projects in Brazil and in Argentina

From a materialist conception of language, methodologically supported by Discourse Analysis, we intend to analyze law project proposed in Brazil (5198/2020 and 5.248/2020), a law (RESFC-2020- 900-APN-DI#INAES) and a law project in Argentina that aim to regulate the use of what has been called neutral or inclusive language. To this end, we will work with the legal functioning of laws and projects, considering the segregation effect (Orlandi, 2003) produced by them. We aim to understand the effects, above all, of the interdiction of an enunciation already in use. We consider that although some of these regulations assume that the use of neutral/inclusive language could bring “communication problems”, when they legislate or wish to legislate on its use, they not only recognize its existence but also, in a certain way, legitimizes its use, as something potentially transformative to the point that seems necessary to use the law to stop it.
