The purpose of this article was to analyze, based on the debates that have taken place in society and the government, the use of artificial intelligence in the Brazilian Public Health System and its positive and negative impacts on guaranteeing the right to universal and egalitarian health. This article also examined the state of the art regarding the regulation of artificial intelligence and the studies promoted by the federal government. The use of artificial intelligence in health certainly brings many advantages and risks which cannot even be fully measured, which is why it is necessary to expand debates of an ethical, legal, moral, cultural and medical nature, as it is a present and growing reality in society, in almost all its fields of activity. This technological system must be regulated by the government for the promotion of its positive use, prohibition of excesses such as data manipulation, and selective use for the benefit of a few.
